Committee on the Rights of the Child

The Committee on the Rights of the Child (CRC) is the body of independent experts that monitors implementation of the Convention on the Rights of the Child by its State Parties. It also monitors implementation of two Optional Protocols to the Convention, on the involvement of children in armed conflicts and on the sale of children, child prostitution and child pornography.

The UN General Assembly called for the Study on Violence Against Children in 2001 acting on the recommendation of the Committee on the Rights of the Child.

In overseeing the implementation of the Convention on the Rights of the Child, the Committee held two days of general discussion on the issue of state violence against children (2000) and violence against children within the family and in school (2001).

CRC Days of General Discussion

The CRC holds a day of general discussion each year. The discussion day is a public meeting, which takes place at the Office of the United Nations High Commissioner for Human Rights, Palais Wilson, Geneva.

Day of General Discussion on “Children without parental care”

The Convention on the Rights of the Child is the most widely ratified international human rights instrument, with 192 States Parties.

The UN General Assembly 2002 Special Session on Children recognized that there are currently many children who are orphaned or otherwise separated from their parents due to a large variety of reasons. It adopted a Plan of Action which committed Member States to take special measures "to support such children and the institutions, facilites and services that care for them, and to build and strengthen childrens' own abilites to protect themselves".

The Committee on the Rights of the Child, the body of independent experts responsible for reviewing progress made by States Parties in implementing the Convention on the Rights of the Child decided at its 37th session to devote its 2005 day of general discussion to the subject of “Children without parental care" in order to improve implementation of the Convention on this topic and identify practical solutions and steps for ensuring that the rights of children living without parental care are respected.

The Committee has identified three main areas to be considered during the day of general discussion:

- What types of legal frameworks are most likely to ensure that the rights of the child are safeguarded before, during and after separation from parents?

- What family support and alternative care policies can be recommended to help prevent and reduce separation and ensure the most appropriate use of alternative substitute care?

- What opportunities exist for increasing the participation of children in measures to keep them in safety with their family, and in other decisions about their care, including those pertaining to removal, alternative care placements, and reunification?
